Terms & Conditions

1. Introduction

These Terms and Conditions govern the relationship between Navire ("we", "us", "our"), a yacht charter operator registered at 10/3 Ao Po Grand Marina, Pa Klok, Thalang, Phuket 83110, Thailand, and any person ("you", "the guest") who submits an enquiry, confirms a booking, or boards any vessel operated by Navire.

By making a booking with Navire — whether by telephone, email, or web form — you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them. If you are booking on behalf of a group, you accept responsibility for ensuring that all members of your party are aware of and comply with these terms.

2. Bookings & Confirmation

A booking is considered confirmed only when:

  • Navire has received your completed booking enquiry;
  • Navire has confirmed the availability of the requested charter date and programme in writing (by email or message); and
  • The required deposit payment has been received in full.

Navire reserves the right to decline any booking request at its discretion, without obligation to provide a reason. Verbal or informal confirmations do not constitute a binding agreement.

3. Pricing

All prices are quoted in Thai Baht (฿) and include the services described for each charter programme. Prices are subject to change; the price confirmed in writing at the time of booking will be honoured for that booking.

The following are not included in the charter price unless explicitly stated in writing: port fees for multi-day itineraries, national park entry fees (where applicable to the Surin Islands or similar areas), alcoholic beverages beyond those listed in a programme description, personal travel or medical insurance, and gratuities.

Navire does not levy surcharges after a booking is confirmed, except where a significant and unforeseen increase in fuel costs requires adjustment. In such cases, Navire will notify you as early as possible and you may cancel without a financial penalty.

4. Payment

A deposit of 30% of the total charter price is required to confirm your booking. The remaining balance is due no later than 7 days before the charter departure date. For bookings made within 7 days of the departure date, the full amount is due at the time of confirmation.

Accepted payment methods will be confirmed at the time of booking. Navire does not store card details. Payments made in foreign currencies are converted at the prevailing rate at the time of transaction; Navire is not responsible for currency exchange differences.

5. Cancellation by the Guest

If you need to cancel a confirmed booking, please notify us in writing as soon as possible. The following cancellation policy applies:

  • More than 14 days before departure: Full deposit refunded, less a ฿1,500 administrative fee.
  • 7–14 days before departure: Deposit retained; balance payment (if received) refunded in full.
  • Less than 7 days before departure: No refund of any amounts paid.
  • Same-day cancellation or no-show: Full charter amount is forfeit.

We recommend that all guests arrange personal travel insurance that includes charter cancellation cover.

6. Cancellation or Modification by Navire

Navire will endeavour to operate all confirmed charters as scheduled. However, we reserve the right to modify or cancel a departure in the following circumstances:

  • Adverse weather conditions that, in the captain's judgement, make the voyage unsuitable;
  • Mechanical issues that cannot be resolved safely before departure;
  • Official advisories from the Thai Marine Department or relevant authorities;
  • Circumstances beyond our reasonable control.

Where Navire cancels a departure, you will be offered an alternative date or a full refund of all amounts paid. Navire is not liable for any consequential losses (e.g., flights, accommodation) arising from a cancellation.

Where possible, Navire will notify you of a cancellation no later than 18:00 on the day prior to departure. In the case of unexpected conditions, the captain may make the final safety determination on the morning of departure.

7. The Captain's Authority

The captain of any Navire vessel has full and final authority over all decisions relating to navigation, safety, and the conduct of guests aboard. This includes the right to alter or curtail an itinerary, refuse embarkation, or disembark any guest whose behaviour is deemed unsafe, disruptive, or contrary to these terms.

Guests are required to follow all reasonable instructions from the captain and crew at all times. Failure to do so may result in removal from the vessel without refund.

8. Guest Responsibilities

Guests are responsible for:

  • Arriving at the marina departure point (10/3 Ao Po Grand Marina) no later than 15 minutes before the scheduled departure time. Late arrival may result in departure without the guest, with no refund obligation on Navire's part.
  • Disclosing any medical conditions, mobility limitations, or dietary requirements relevant to the charter at the time of booking.
  • Ensuring that all members of a party, including children, are able to participate safely.
  • Treating the vessel, its equipment, and crew with reasonable care and respect.
  • Complying with all Thai maritime regulations and national park rules where applicable.

9. Damage to the Vessel

Guests are liable for any damage to the vessel or equipment caused by misuse, negligence, or failure to follow crew instructions. Navire will provide a written assessment of any damage within 5 business days of the charter completion. Repair costs will be communicated and reasonable evidence (photographs, repair quotes) provided.

10. Limitation of Liability

Navire's liability in respect of any claim arising from the provision of charter services is limited to the price paid for that charter. We are not liable for any indirect or consequential loss, including but not limited to missed flights, accommodation costs, or loss of income.

Navire maintains appropriate marine insurance for its vessels and crew. Guests are advised to arrange their own personal travel and medical insurance before departure. Navire is not liable for any personal injury, illness, or loss of personal property unless directly and solely caused by Navire's negligence.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any other matter that cannot lawfully be excluded or limited.

11. Health & Safety

All Navire vessels carry the required safety equipment in accordance with Thai maritime regulations. Crew members are trained in first aid and emergency procedures. Life jackets are available for all guests and must be worn when instructed by the crew.

Guests who have consumed excess alcohol or are otherwise impaired may be refused embarkation or disembarked during a voyage. No refund will be given in such circumstances. Navire's crew reserve the right to limit alcohol consumption during a charter in the interest of safety.

12. Photographs & Privacy

Navire crew members may take photographs or short video clips during a charter for use in our promotional materials, including our website and social media. If you prefer not to appear in such materials, please inform us in writing before departure. We will not use images in which individuals are clearly identifiable without their prior consent.

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Thailand. Any disputes arising from or relating to these terms shall be subject to the jurisdiction of the Thai courts. Navire will always seek to resolve any concerns informally and amicably before formal proceedings are considered.

14. Amendments

Navire may update these Terms and Conditions from time to time. The version in effect at the time of your booking confirmation will apply to that booking. Current terms are always available on our website.
